Our Mission

Mandate and Functions

The NACC also undertakes the following functions stipulated in the law that established it, and other applicable laws:

 

– Law No. 175 of 8 May 2020 stablishing the National Anti-Corruption Commission.

– Law No. 28 of February 10, 2017 on the Right of Access to Information.

– Law No. 83 of October 10, 2018 on the Protection of Whistleblowers.

– Law No. 84 of October 10, 2018 Enhancing Transparency in the Petroleum Sector.

– Law No. 189 of October 16, 2020 on Asset and Interest Declarations.

– Law No. 214 of April 8, 2021 on the Recovery of Funds Derived from Corruption Crimes.

– Law No. 244 of July 29, 2021 on Public Procurement.

  • Receive disclosures and complaints related to corruption, investigate and look into corruption crimes, either routinely or in response to received disclosure forms, and refer them, when necessary, to the competent oversight, disciplinary and judicial authorities.

 

  • Protect and incentivize whistleblowers, as necessary.

 

  • Receive, investigate and decide on complaints related to the application of the Right of Access to Information Law, and prepare the annual report and other ad-hoc reports.

 

  • Receive, follow up and manage assets and interests’ declaration forms, especially in terms of storing and controlling their content.

 

  • Coordinate and follow-up with the competent authorities, through the “Department for the Recovery of Funds Derived from Corruption Crimes” established within the NACC, with regard to recovering funds derived from corruption crimes, and identify the challenges that the Department faces.

 

  • Monitor the status of corruption, including its cost, causes, and efforts to combat and prevent it in light of the laws in force, approved policies and binding conventions, and draw up relevant annual, periodic, and special reports.

 

  • Contribute to spreading the culture of integrity and knowledge needed to combat and prevent corruption in public administrations, institutions and society at large, and train public servants and officials on related topics.

 

  • Draft, recommend and express opinions, either upon its initiative or upon the request of competent authorities, on the provisions of laws, , decrees, decisions and drafts thereof, and anti-corruption policies and strategies.

 

  • Monitor the proper application of the Law on Enhancing Transparency in the Petroleum Sector and ensure that the relevant parties specified in it comply with the publication and/or disclosure of information.

 

  • Participate, through its President, in the formation of the special committee for evaluating accepted nominations for membership in the Public Procurement Authority.
